The Digital Asset Market Clarity Act, a long-hyped piece of legislation establishing a federal framework for cryptocurrency, failed to clear a key Senate vote this week and now looks dead for 2026. It represents a resounding defeat for crypto stakeholders with multiple ramifications for the gaming industry.
At least 60 “yes” votes were needed to move the legislation towards passage, but the final tally of 49-50 didn’t even reach a majority after four Republican lawmakers broke ranks to oppose the market structure bill. With critical midterm elections approaching in November, there is little chance that the issue will be picked back up in the balance of the Congressional session.
Notably, ethics concerns may have played a critical factor in the rejection of the bill. Lawmakers from both sides did not feel that an updated version of the text released on Sunday went far enough in addressing concerns related to senior officials maintaining or endorsing crypto business ties. However, a group of Republicans claimed they made a series of concessions when US President Donald Trump agreed to modifications on Sunday night that contained stronger ethics measures, the Associated Press reported. The 11th hour concessions were not enough to appease potential swing voters among Senate Democrats.

During the livestream, the president stated that he had spoken with a woman who said her 26-year-old son had taken his own life because of online betting. He also mentioned hearing from a bettor who had racked up BRL2 million ($388,410) in debt in just three months of wagering.
Lula said he intends to discuss the matter with his team and analyse potential measures to consider the social impact of online betting.
What the president does not acknowledge is that the government relies on revenue from the sector. In just the first seven months of 2026, BRL8.747 billion generated by sports betting has already flowed into public coffers. The Federal Revenue Service estimates the total could reach BRL16 billion by the end of the year. In 2025, nearly BRL9 billion was collected from sportsbooks.

Financial advisors continue to urge consumers to view sports wagering strictly as entertainment and to only risk funds they can afford to lose.
Research from Stanford University published in April concluded that sports bettors remain “overoptimistic,” generally expecting to break even despite losing an average of 7.5 cents on every dollar wagered.
“Overoptimism is largest among bettors who partake in a complex type of bet known as a parlay,” the Stanford researchers wrote. “Compared to other forms of betting, parlays are more likely to be driven by bias.”
